First step after Asylum application

Last update : September 2025

When you apply for asylum in Austria, the first thing they check is whether another Schengen country is responsible for your asylum case.
• This is checked through fingerprints or other evidence (for example: tickets, coins, things you say).
• If another country is responsible, your application will not be processed in Austria.
• Instead, Austria will try to send you back (deport) to that country.
If you get a negative Dublin decision
• You can appeal within 2 weeks at the BFA.
• It is very important: contact a lawyer or legal aid quickly to help you!
Where you stay during the Dublin procedure
If you are in the Dublin procedure, you will be brought to one of the three Federal Reception Centers:
• Traiskirchen (the biggest)
• Thalham (smaller)
• Schwechat Airport (if you arrive by plane)
Time limits for deportation
• If Austria decides to deport you, they have 6 months to do it (counting from the day the other country agrees).
• If they do not deport you in this time, then Austria becomes responsible for your asylum case.
Important: If during these 6 months you are not registered (Meldezettel) or not available to the authorities, the time can become 18 months.
To which countries?
• Austria has stopped deportations to Greece.
• Deportations to Hungary are often suspended, but this can change anytime.
• Deportations to Italy, Slovenia, and other countries are still happening.
• Please always check with legal aid to know the latest situation.
