The best interest of the child is the only relevant criterion in the case of unaccompanied minors. For that, the possibility of family reunification is studied, together with the capacity of the family members to receive the child. If possible, the asylum application of an unaccompanied minor will take place where a family member is present.

The best interest of the minor is to be considered in regard to:

  • the possibilities of family reunification;
  • the minor’s well-being and social development;
  • the child safety and security aspects, particularly if there is a risk that the minor has been or is likely to be a victim of trafficking in human beings; and,
  • the child views, taking into account age and maturity.
